Ex-Director of MAM Rio Fined for Saying Museum Lacked Fire Insurance

Fábio Szwarcwald, former executive director of the Museu de Arte Moderna do Rio de Janeiro (MAM Rio) from 2020 to 2022, has been fined 100,000 reais (about $20,000) for breach of contract. The fine stems from his 2022 public statement that the museum had lacked fire insurance from 2006 to 2022, which led to his resignation. The Rio de Janeiro court of appeal ruled that, even if true, his comments violated a confidentiality clause and damaged the museum's reputation. The court also ordered MAM Rio to pay Szwarcwald outstanding compensation owed from May 2021 to January 2022. Szwarcwald plans to appeal, arguing his statements did not breach his contract and that the museum's insurance status is not a trade secret.

This case matters because it highlights tensions between transparency and institutional confidentiality in the art world, particularly regarding safety and risk management. MAM Rio, which houses some 16,000 works including pieces by major artists like Tarsila do Amaral, Constantin Brâncuși, and Hélio Oiticica, was severely damaged in a 1978 fire that destroyed about six hundred works. Szwarcwald had pushed for fire safety improvements and insurance during his tenure, but the board resisted as operating costs surged. The ruling raises questions about the obligations of museum leaders to speak publicly about critical safety issues versus contractual restrictions, and underscores the ongoing vulnerability of cultural institutions to fire hazards.
